Privacy Policy

This privacy policy describes in detail how Temp-Team A/S (we, us, Temp-Team) processes your personal data. It applies in the following situations:

  • When we assist you in finding a job.
  • When we maintain contact with you after assisting you finding a job.
  • When you visit our website.
  • When we provide a service to you as a client.
  • When we receive a service from you as a supplier.
  • When we process your information in relation to one of our candidates, e.g., as a reference.

The policy explains how we collect your information, how we use it in practice, and the security measures we have in place to protect it. We also ensure compliance with all applicable legal obligations, including data protection regulations. We prioritize your privacy and are committed to safeguarding your rights concerning your personal data.

Temp-Team is part of Juhler Holding, CVR number 66891712, an international group of staffing and recruitment agencies. We are represented in Denmark, Sweden, Norway, Finland, and the United Kingdom through the companies Temp-Team A/S, Unique Human Capital, Temp-Team AB, Temp-Team AS, Temp-Team Oy, RC Professional Search, Temp-Team Services, Education World Ltd., and Principal People.

 

Privacy Policy for Temp-Team A/S

Temp-Team is committed to protecting the personal data of our candidates, clients, and website visitors. We strive to provide a safe and secure user experience and ensure that any information you submit to us via our website is used solely for the purposes outlined in this policy.

 

How We Collect and Use Your Information

We process your personal data to provide our recruitment and staffing services, including HR tasks, temporary staffing, payroll, recruitment, payroll administration, and personnel management. To use our services, you must at a minimum provide your name and contact information. Additionally, we may request further information such as your CV, relevant educational and work experience, certifications, language skills, or geographical preferences to better match you with suitable job opportunities and meet our clients' specific needs. It is your responsibility to ensure that the information you provide us is accurate and up to date.

This section specifically concerns information containing personal data.

In some cases, this may also include sensitive personal information such as criminal record details. Personal data is therefore handled and protected in accordance with the relevant provisions of the Data Protection Act and the General Data Protection Regulation established by the EU. This information is stored, used, and disclosed by us to:

  • ·         Provide our services to you.
  • ·         Maintain our professional relationship where you are a user of our CRM system as a client or candidate.
  • ·         Enable you to upload your CV for general applications or to apply for specific jobs. Please see the section on CVs below for more information.
  • ·         Match your information with job vacancies, help find a position that suits you and send your personal information (including sensitive personal data) to clients in connection with your job search.
  • ·         Respond to your inquiries.
  • ·         Market products and services directly, advise you on news and industry updates, events, promotions and competitions, reports, and other information. When we do this, you have the option to opt out of such communications.
  • ·         Fulfill contractual obligations to our clients.
  • ·         Disclose information to third parties with whom we collaborate and to provide services that you or our clients have requested, such as reference and criminal record checks (as needed) or skills and personality tests. These third parties adhere to the same privacy and confidentiality obligations as Temp-Team.
  • ·         Disclose information to third parties that perform functions on our behalf and provide services to us, such as advisors, IT consultants who perform testing and development work on our systems, or software providers we use for online time registration. These third parties adhere to the same privacy and confidentiality obligations as Temp-Team.
  • ·         We may disclose data to third parties where we are required to do so by regulations or legislation, such as public authorities, insurance and pension companies, employer associations, as well as potential or intended employers and our clients to enable you to perform your task for them.
  • ·         If Temp-Team A/S merges with or is acquired by another company, we may share personal information with the new owners of the company and their advisors. If this happens, you will be notified.
  • ·         We may disclose personal information to public authorities if they require us to do so. We will also disclose your information about where we are legally obligated to do so.
  • ·         We may seek your consent to collect, store, use, and possibly disclose your personal information for any other purpose not listed above. For example, if you fill out a form on our website.
  • ·         Our website may also use an analytics and user behavior tool that can record clicks, activity, scrolls, etc. Data collected by this service is used to improve the usability of our website. The collected information is stored and used for aggregated and statistical reporting and is not shared with others.

 

Information We May Find Necessary to Collect

Temp-Team may process information within the following categories, which are necessary to provide our services to clients and candidates:

Information required from a client may include:

  • ·         The company's name, CVR number, and basic contact information.
  • ·         Name and contact information of contact persons.
  • ·         Information related to maintaining the customer relationship, such as order details, billing information, meeting information, etc., as well as any notes, contract details, other communication between the parties, permissions and prohibitions regarding direct marketing, and information on the disclosure of necessary information to maintain the customer relationship.
  • ·         Temp-Team processes personal data for relevant individuals working for companies we collaborate with. We do this to provide quotes and/or deliver information about our services and other activities, request and review quotes and information about services and products for Temp-Team, maintain a business relationship, and enter into agreements and manage orders.

Job Seekers:

  • ·         Basic information such as name and contact details.
  • ·         To assess potential job matches; including specific information regarding education, profession, skills, and information about permits and certificates related to the job within the framework defined by law (e.g., information about driver's licenses, work permits, etc.), information about security clearances, and presentation of a criminal record with identifying information. Additionally, there may be information about the job seeker's personal circumstances and information related to professional and personal tests.
  • ·         Information related to the job seeker's previous or current employment, such as employers, employment periods, and the quality of work tasks.
  • ·         Recommendations provided by the job seeker or information given by the references named by the job seeker.
  • ·         Information regarding the candidate's job search, such as desired job, desired salary, preferred work location, and any information related to the start and end dates of the job.
  • ·         Other information provided by the job seeker that is relevant to assess the job seeker's skills, experience, and suitability, such as interview notes, any work-related restrictions, or information about hobbies, volunteer work, etc.
  • ·         We give you the opportunity to upload your CV by creating a profile in our CRM system. You can do this either to apply for a specific posted job or to be considered by our recruiters for positions as they arise. Your CV will be stored in Temp-Team's database and will be accessible to Temp-Team's recruiters in Denmark. You can update your CV at any time by logging into your profile and uploading a new CV.

 

Employees: In addition to the aforementioned information about job seekers, the following information is necessary to maintain the employment relationship:

  • ·         Information required to enter an employment relationship, such as CPR number, information from identity cards, residence permits, etc.
  • ·         Information necessary for payroll processing, such as working hours, absences, salary or bonus basis, illness, leave, maternity leave, etc.
  • ·         Information necessary to maintain safety and well-being in the workplace, such as information about the employee's physical or mental conditions that need to be considered, as well as information about the next of kin.
  • ·         Information necessary for the employment relationship with the client, such as child certificates and security clearances.
  • ·         Information necessary to evaluate work performance, such as performance assessments given by employers, possible comments or warnings, etc.
  • ·         Information necessary for the fulfillment of mutual rights and obligations in connection with the employment relationship, such as notes on discussions between Temp-Team and the employee, e.g., development interviews or negotiations such as salary negotiations.

Additionally, information about criminal offenses is considered semi-sensitive personal data under Danish law.

There may be special situations where we handle information not listed above or where information is processed on a different basis, such as information we receive in connection with a criminal conviction or if events trigger a need for other information to be collected.

We guarantee that the temporary workers who work for us have proper conditions through our membership of the Federation Flexible Workforce.

 

Disclosure of Personal Data

In several cases, Temp-Team must or may disclose your relevant information to appropriate recipients, such as:

  • SKAT regarding taxable benefits
  • The Labor market’s Supplementary Pension (ATP)
  • ACF (Employers' Central Holiday Register), the Labor market’s Holiday Fund, and Holiday Account
  • Statistics Denmark
  • NemKonto
  • Pension funds, banks, and insurance companies
  • Union representatives and trade organizations (upon request)
  • The Danish Working Environment Authority (work injury reports)
  • Employers' Education Contribution (AUB)
  • The Danish Agency for Labor Market and Recruitment (job creation schemes)
  • Municipalities regarding unemployment benefit reimbursement
  • Virk.dk
  • The Income Register
  • The Industry’s Maternity
  • External auditors
  • External advisors, including lawyers / Danish Chamber of Commerce

In the event of disclosure, it will occur within the framework of data protection regulations.

We may also choose to use external data processors. In such cases, we enter into a written data processing agreement that ensures compliance with applicable regulations.

 

Aggregated Information About Online Visitors

We collect information and statistics about all visitors on our website, such as which areas users access most frequently. We only use such data in aggregated form. This information helps us determine what is most beneficial for our users and how we can continuously improve our online services to create a better overall experience.

We may also conduct marketing profiling to identify services or jobs that may interest you.

How Are These Data Secured?

The security of your data is extremely important to us. Access to your personal information is granted only to our staff and the third parties mentioned above. We do not retain your data for longer than necessary. The information is collected in databases protected by firewalls, passwords, and other technical measures. The databases are in locked, secure premises, and the information can only be accessed by specifically selected individuals who have been granted special access rights.

To protect personal data, we implement appropriate technical and organizational security measures. We continuously work on updating and testing our information security technology.

Information is retained for the period necessary according to applicable law, after which it is deleted. Personal data will not be stored longer than necessary for each processing and no longer than we are entitled to under applicable law. We delete data on candidates who are not or have not been employed by Temp-Team two years after registration. The candidate can always request deletion via settings on the candidate profile or by sending an email to info@temp-team.dk.

For the technical execution of data processing, some of the data may be physically located within the EU / EEA area on Temp-Team's external subcontractors' servers, from where it is processed via a technical access connection in compliance with legal obligations. Data will not be transferred outside the European Union or the European Economic Area but may be accessed by relevant Juhler Holding employees in the United Kingdom.

We limit access to personal data to Juhler Holding employees who need the data to provide the service we offer. Personal data can be accessed by employees in finance departments, accounting, and certain recruiters working across our sister companies in Denmark, Sweden, Norway, Finland, and the United Kingdom.

Our IT department has access to all databases, but for example, only employees in our companies' finance departments and payroll accounting can see employees' CPR numbers. Additionally, we have specially selected super users who have full access to all information in all databases.

We provide ongoing training for employees on data protection to maintain security and data integrity. We are responsible for our employees' actions and take necessary measures if errors or deficiencies in their behavior are discovered.

Certain personal data is available to Temp-Team for an extended period, for example for use in connection with complaints, work injuries, or tax obligations.

 

Special Note on Transfers to Recipients Outside the EU

Temp-Team A/S may transfer your personal data to recipients outside the EU and EEA. This includes relevant employees at Education World and Principal People, which are in the United Kingdom and are part of Juhler Holding.

The EU Commission approved the United Kingdom as a safe third country on June 28, 2021, in relation to both the General Data Protection Regulation and the Law Enforcement Directive. This was done by issuing two so-called adequacy decisions, which means that personal data can be transferred to the United Kingdom without a transfer basis.

 

Consent

We need your consent for activities that are not covered by our legitimate interests, including the collection of data via cookies and the delivery of direct marketing to you via digital channels. Depending on the situation, we will request this via an opt-in or soft opt-in (see below for more details). Please note that in certain jurisdictions where we operate, we also comply with local legal requirements.

Soft opt-in consent is a specific form of consent that applies when you have previously been in contact with us, for example by submitting a job application or creating a profile, and we market other recruitment-related services. With soft opt-in consent, we consider your consent given unless you choose to opt out. For most people, this is beneficial as it allows us to suggest other jobs to you beyond the specific job you applied for, increasing the likelihood of finding a new position for you. For other forms of e-marketing, we are required to obtain your explicit consent.

 

Right to Opt-Out

If you are not satisfied with our marketing or no longer wish to receive marketing communications from us, you have the right to withdraw your consent at any time by clicking an unsubscribe link or by sending an email to info@temp-team.dk. While we comply with your request, we would like to inform you that your information may still be collected through public media such as LinkedIn or Jobindex in connection with an unrelated marketing campaign. We will do our best to prevent this from happening.

 

Internet-Based Transfers

As the internet is a global environment, using the internet to collect and process personal data necessarily involves an international transfer of data. By visiting our website and communicating with us electronically, you agree to our processing of your personal data in this way. Data will not be transferred outside the European Union or the European Economic Area but may be shared with Juhler Holding employees in the United Kingdom.

 

Equal Treatment

Temp-Team is committed to working with diversity and the principle of equal treatment. This means that all job applicants and employees will be treated equally, and we do not discriminate based on gender, marital status, race, ethnic origin, skin color, nationality, origin, disability, sexual orientation, religion, or age. As part of our commitment to equal treatment, we may occasionally use this information for purposes such as ESG reporting. All such information will be treated anonymously.

 

Your Rights

Under GDPR rules, the following applies:

  • You have the right to request a copy of the information we hold about you at any time. You have the right to make a subject access request. When you make a subject access request, we will respond within one month; under certain circumstances, this period may be extended to two months. We may ask you to verify your identity and provide further information to process your request. Where we are legally entitled to do so, we may refuse your request and provide you with a reason for this. If you wish to make a subject access request, you can contact us at info@temp-team.dk.We will not charge fees or refuse to respond to your subject access request unless you have made repeated requests for the same information.
  • You can request the deletion of your personal data. This allows you to ask us to delete or remove personal data where there is no good reason for us to continue processing it. You also have the right to ask us to delete or remove your personal data if you have exercised your right to object to processing (see below), if we have processed your information unlawfully, or if we are required to erase your personal data to comply with local law. However, please note that we may not always be able to comply with your deletion request for legal reasons. If applicable, we will inform you of this at the time of your request. We delete data on candidates who are not or have not been employed by Temp-Team two years after registration. The candidate can always request deletion via settings on the candidate profile or by sending an email to info@temp-team.dk.
  • Object to the processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your situation that makes you want to object to processing on this ground as it impacts your fundamental rights. You also have the right to object to where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights.
  • To request a restriction on the processing of your personal data. This allows you to ask us to suspend the processing of your personal data in the following scenarios: (a) if you want us to establish the data's accuracy; (b) if our use of the data is unlawful but you do not want us to delete it; (c) if you need us to retain the data even though we no longer require it, as you need it to establish, exercise, or defend legal claims; or (d) if you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it. You also have the right to request Temp-Team to be set inactive or have your profile deleted. If you request the deletion of your data, please be aware that we may not be obligated or able to comply with this request, especially if your data contains information about our customers or financial information that we are required to retain, for example, in relation to tax matters. If we cannot comply with your request, we will provide you with the reason for this.
  • To withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain services to you. We will inform you if this is the case at the time you withdraw your consent.
  • To have inaccurate information about yourself corrected, for example if you have provided an incorrect address.

 

In the event of a personal data security breach

In the event of a personal data security breach, Temp-Team is obligated to report the incident to the Data Protection Authority within 72 hours and notify the affected individuals.

In all cases of personal data security breaches, Temp-Team has an obligation to document the actual circumstances of the security breach, its effects, and the remedial measures we have taken to demonstrate to the Data Protection Authority that we have addressed the security breach.

If a personal data security breach occurs involving personal data that Temp-Team processes for other companies / partners, we have a duty to notify these companies / partners.

A breach of personal data security can, for example, technically occur if Temp-Team's IT systems containing personal data are not sufficiently secured, allowing external parties to access the information (e.g., hacking). However, it can also be Temp-Team's handling of personal data that causes a security breach, for example if Temp-Team unintentionally discloses or alters personal data. Examples of personal data security breaches include the following situations (not exhaustive):

  • ·         Persons other than those authorized at Temp-Team gain access to personal data. This can include individuals both outside and within the organization.
  • ·         Temp-Team employees accidentally alter or delete personal data, or data is lost due to incidents such as fire or flooding.
  • ·         Breaches of Temp-Team's servers where unauthorized individuals have accessed personal data, such as CPR numbers.
  • ·         Temp-Team employees, either knowingly or unknowingly, disclose personal data about a candidate or customer to another candidate or customer, or even to multiple unauthorized individuals.
  • ·         Inadequate encryption of the login page for customers and candidates, containing e.g., a candidate login, which results in one or more unauthorized individuals gaining direct access to the candidate's personal data.

If you are unsure whether a situation constitutes a personal data security breach, it is better to report it just in case rather than risk overlooking it.

 

Complaints

We strive to assist you and resolve any issues related to the collection, processing, storage, handling, and deletion of your data. However, you have the right to file a complaint with the Data Protection Authority.

 

Changes to Our Privacy Policy

This privacy policy may be updated by Temp-Team at any time. If changes occur, we will inform you by posting a clear notice on our website. Continued use of our website or services after updates will be considered your acceptance of the revised terms.
